Listed properties (heritage-protected real estate)

When purchasing listed buildings (beni cultural), you should bear in mind that these are usually subject to strict requirements regarding possible restoration work. This means you cannot simply renovate or alter the property according to your wishes but must comply with rigid regulations. Therefore, before making a purchase decision, consult an expert to find out to what extent you are allowed to make changes to the property.

Furthermore, the Italian state has a pre-emptive right (dritto di prelazione) on listed properties. Have the notary (notaio) check before signing the purchase contract (rogito) whether the state intends to exercise this right.


The notary will then usually apply for permission to manage (gestire) the property after the preliminary contract has been signed. If no claim is made on the property within 60 days, the notarial purchase contract can be signed. Otherwise, the preliminary contract becomes void and the buyer receives their down payment back.
