Sale of the rented property

In the event that the property you are renting is to be sold, as a tenant (locatario/conduttore) in Italy you enjoy a pre-emptive right (diritto di prelazione). If you decline, the landlord must offer the property to other interested buyers under the same conditions and may not sell it at a lower price; otherwise, you have the right to challenge the sale.


Your rental contract is not affected by the sale of the property, meaning your lease continues even after the change of ownership, and the conditions (clausole contratuali) may not be altered. After the expiration of the contract term (decorrenza), however, your new landlord (locatore) has the right to renegotiate the terms with you or to terminate the lease by observing the generally applicable notice periods.
