The transitional rental contract

“Contratto di locazione di natura transitoria”

The “contratto di locazione di natura transitoria” can be concluded for a duration of between one and 18 months and may only be used if the landlord or the tenant can demonstrate a temporary need (esigenze temporanee)—a classic example being temporary work assignments abroad.

The monthly rent is agreed upon between the parties. In major cities and their suburbs, this is tied to municipally established minimum and maximum values. In all other areas, the rent may be freely determined between the parties.

The contract may only be extended under the same conditions (condizioni contratuali) if, at the time of renewal (rinnovo del contratto), proof (dimostrazione) of the temporary need is again provided. Otherwise, the contract automatically converts into a free contract with a term of 4+4 years (see The free rental contract).
